Welcome to Minfair. These Terms of Service ("Terms") govern your access to and use of the services provided by MoaiStudio ("we," "us," or "our"). By using our services, you agree to be bound by these Terms.

Section 1. Scope and Application

1. These Terms define the relationship between MoaiStudio and users of our online tools.
2. If specific guidelines or additional terms are provided for a particular tool, those terms shall supplement these Terms. In case of a conflict, the tool-specific terms will prevail.

Section 2. Account Registration and Management

1. Users may use parts of the service without an account, but registration may be required for specific features.
2. When creating a Room as a guest, users must follow system requirements such as setting an admin password. Furthermore, in the event that a non-member loses their administrative password, MoaiStudio will be unable to verify their identity and thus cannot respond to requests for editing or deleting the Room.
3. Accounts are for personal use only and may not be transferred or shared. We are not liable for any damages resulting from inadequate account management.

Section 3. Usage Environment and Multi-platform Support

1. This service is provided across different environments such as web browsers and dedicated apps. Users acknowledge that available features and displays may vary depending on the environment.
2. When using the service across multiple environments with the same account, rights or data acquired in one environment may be available in others. However, this is subject to limitations based on environment specifications or platform policies.
3. The Service is provided through the Japanese version "みんフェア" (minfair.com), the English version "Minfair" (en.minfair.com), and the dedicated applications for browsing these (hereinafter referred to as the "App Version").
4. The Japanese and English versions are operated with independent databases and account systems. Even if the display language is changed using the switching function within the Service, registered data, account information, and the status of paid plans defined in the following article are managed separately for each language version and will not be shared, synchronized, or transferred between them.

Section 4. Usage Fees

1. While basic features are free, certain premium features may be offered for a fee in specific environments. Pricing and details are subject to the terms presented in each environment.
2. Payments for paid features are processed through methods designated by the Service.
3. Procedures and conditions for payment timing, renewal, and cancellation are subject to the rules of each payment method.
4. Paid plans, such as the "Business Membership Plan", are valid only for the specific language version (Japanese or English) for which the contract was concluded.
5. When the same user uses the same language version on both the App Version and the Web Version, the rights to the paid plan are shared. However, paid plans cannot be applied across language versions (e.g., subscribing to the Japanese version and using it on the English version). To use paid features in each language version, separate contracts and payments are required for each version.

Section 5. Room Creation and Visibility Settings

1. When creating a Room on this Service, the default setting for "Privacy Settings" is "Public (Visible in Public Rooms)", and the Room will be published in the "Public Rooms" section.
2. Users shall be responsible for checking and selecting the scope of visibility (Public, Private, etc.).
3. MoaiStudio shall not be liable for any damages (privacy infringement, information leakage, or any other disadvantage) resulting from a user's failure to check visibility settings, which leads to unintended viewing or disclosure of content to third parties.

Section 6. Prohibited Conduct

Users are prohibited from engaging in the following activities (including acts that induce or prepare for such acts):

1. Violating any laws, regulations, or public order.
2. Violating these Terms or any individual terms set by the Service.
3. Infringing upon the rights, property, or privacy of MoaiStudio, other users, or third parties.
4. Unauthorized access, distribution of malware, or interfering with the system’s integrity.
5. Impersonation or fraudulent use of accounts and Rooms.
6. Infringing on intellectual property rights, including copyrights and trademarks (we respond to valid DMCA notices).
7. Posting or sharing content that is violent, obscene (including child pornography), discriminatory, criminal, or harassing.
8. Unauthorized commercial use, including spamming, advertising, or solicitation.
9. Reverse engineering, decompiling, or analyzing the service’s source code.
10. Imposing an excessive load on our servers or disrupting service operations.
11. Any other conduct deemed inappropriate by us.

If a user engages in any prohibited conduct, or if MoaiStudio deems content to be inappropriate at its sole discretion, MoaiStudio may hide or delete content (such as Rooms) without prior notice. Furthermore, MoaiStudio may take similar measures when it is determined necessary for operational purposes, and we shall not be liable for any disadvantages incurred by the user as a result.

Section 7. Intellectual Property

1. All programs, images, text, and trademarks associated with our services belong to MoaiStudio or its licensors.
2. Unauthorized reproduction, distribution, or modification of our content is strictly prohibited.

Section 8. Data and Privacy

1. We handle personal information in accordance with our Privacy Policy.
2. By using our services, you consent to the data practices described in the Privacy Policy.

Section 9. Disclaimer and Limitation of Liability

1. The service is provided "as is" without any warranties of accuracy, reliability, or fitness for a particular purpose.
2. We are not liable for any damages resulting from the use of the Service, except in cases of willful misconduct or gross negligence.
3. Notwithstanding the previous clause, if the contract is deemed a consumer contract, our liability shall be limited to normal and direct damages, capped at the total fees paid by the user in the past 12 months (or 0 USD for free use).
4. When using the Service through an app store, platform operators bear no responsibility for the provision, support, maintenance, or damages arising from the Service.

Section 10. Governing Law and Jurisdiction

1. These Terms are governed by the laws of Japan.
2. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.

Section 11. Platform Terms of Use

These Terms are concluded between the user and us; platform operators are not a party to these Terms. Users shall also comply with the terms of use set by each platform operator.

Section 12. Governing Language

The authentic version of these Terms is written in Japanese. This English translation is provided for your convenience only. In the event of any conflict or inconsistency between the Japanese version and this translation, the Japanese original shall prevail.

Section 13. Geographic Restrictions

The Service is intended for use by individuals and entities located outside the European Economic Area (EEA) and the United Kingdom. We do not intend to offer goods or services to, or monitor the behavior of, residents or entities located in the EEA or the UK. Access to the Service and entering into contracts for paid subscriptions from these regions is strictly prohibited. We reserve the right to terminate access or delete data for any user found to be in violation of these restrictions.

MoaiStudio ("we," "us," or "our") is committed to appropriately protecting and managing your personal information within Minfair (the "Service") and complying with relevant laws and regulations.

• Account Registration: Nickname, email address, password (stored as a hash).
• Inquiry Information: Name, email address, and the content of your message.
• Usage Data: Access logs, IP addresses, user agents, cookies and other identifiers, pages viewed, and action logs.
• Payment-Related: Information processed by payment service providers (we do not directly store complete credit card information).
• Advertising and Analytics Data: Usage data collected through cookies by analytics tools and advertising services.

3. Purposes of Use

• To provide, operate, and maintain the Service (room creation, viewing, and management).
• For identity verification, account management, and security measures.
• To respond to inquiries and provide important notifications or maintenance info.

The Service uses cookies and similar technologies to maintain login states, understand usage patterns, and deliver advertisements. While you can disable these through your browser or device settings, doing so may limit your access to certain features of the Service.

This information is processed and managed securely and directly by the payment systems of each environment (including platforms operated by app stores).

We retain your personal information only for as long as necessary to achieve the stated purposes of use or as required by applicable laws. When the information is no longer needed, it will be deleted or anonymized securely.

8. International Data Transfer

Your personal information may be transferred to and processed on servers in the United States to provide the Service. While data protection standards in the U.S. may differ from those in your country of residence, you consent to your data being handled in this jurisdiction.

The Service is intended for users located outside the European Economic Area (EEA) and the United Kingdom. We do not intentionally collect or process personal information from residents or entities located in the EEA or the UK. If use from these regions is identified, we will delete the associated data promptly.
